PACA Closes Another Successful Year of Certifications

As we begin 2024, we want to thank all of you that helped us make 2023 another successful year for our certification programs.

The program doesn't happen without our volunteers or those companies that open their doors to us and allow us to use their facilities.

In 2023 those companies included:

  • Centre Concrete
  • Rahns Construction Material Co.
  • Pennsy Supply, a CRH company
  • Conewago Ready Mix
  • Barry Isett
  • New Enterprise Stone & Lime Co., Inc.
  • Rohrers Incorporated

We are always looking for additional volunteers or host facilities. Looking at this year, Boger Concrete will be hosting some programs for us and we thank them in advance for their support!

If you would like to learn more about our programs and how you and/or your company can become more involved, please contact Ken Crank.

Safety & Health News

Final MSHA Powered Haulage Rule

Over the past several years, MSHA (The Mine Safety and Health Administration) has focused on the safety of surface mobile equipment at surface mines and surface areas of underground mines, culminating in a proposed regulation on September 9, 2021. After public hearings and a reopening of the public comment period, MSHA closed the comment period on February 11, 2022.

On December 20, 2023, MSHA issued a final rule with an effective date of January 19, 2024 and a compliance date of July 17, 2024. In this final rule, MSHA states that the purpose of the safety program is to reduce the accidents, injuries, and fatalities related to the operation of surface mobile equipment, promote and support a positive safety culture, and improve miners' safety at the mine. MSHA is requiring that mine operators develop, implement, and update, periodically or when necessary, a written safety program for surface mobile equipment (excluding belt conveyors) at surface mines and surface areas of underground mines. The written safety program must be developed and updated with input from miners and their representatives. The written safety program must include actions mine operators will take to identify hazards and risks to reduce accidents, injuries, and fatalities related to surface mobile equipment.

The final rule applies to all operations regardless of the number of employees. The written program, either in hard copy or electronic, needs to be at least annually evaluated by a responsible person (so long as the designated person(s) has/have the authority and responsibility to evaluate and update the written safety program), or whenever your mining conditions change anything that might affect the health and safety of your employees. The program will be reviewed during routine MSHA inspections. During the inspection, MSHA will review the written safety program to determine if it reflects actions that identify and address surface mobile equipment hazards at mine sites and to verify whether input from miners and their representatives was sought. MSHA will also determine whether the written safety program is adequately evaluated and updated. Independent contractors will need to develop their own programs, which the operator can incorporate into their programs if they want to do so. As you create this program, you must consult with miners and their representatives.

The written program must address maintenance schedules and procedures for mobile equipment—these are not new maintenance and repair procedures, unless operators do not have these in place already; identification of mobile equipment hazards and how you plan to reduce site-specific risks; an identification of current and emerging feasible technologies that can enhance safety and evaluate whether to adopt them; and training of miners and other persons necessary to perform the work. MSHA clarifies that mine operators will only need to integrate existing training provisions, as applicable, into the written safety program.

The final rule states that miners provide input in developing and updating the written safety program. The final rule also clarifies that miners and their representatives will receive, upon request, a copy of the written safety program at no cost.

The final rule defines surface mobile equipment as “wheeled, skid-mounted, track-mounted, or rail-mounted equipment capable of moving or being moved, and any powered equipment that transports people, equipment, or materials, excluding belt conveyors, at surface mines and surface areas of underground mines.” Surface mobile equipment excludes any manually powered tools, such as wheelbarrows, hand carts, push carts, welding carts, cylinder carts, basic hand trucks, or dollies for the purposes of this written safety program.

NRMCA Plant Manager Course Coming to Philadelphia

The NRMCA's popular Plant Manager course is coming to Philadelphia in February 2024.

With over 90% of a producer’s expenses tied to materials management, operations, and production at the plant level, it is essential every concrete plant manager understand the essential aspects of product knowledge, safety, environmental compliance, operations as tied to profit and loss, as well as supervisory principles. A plant manager is the heart of the ready mixed concrete production facility. Every plant has one and duties differ only slightly from plant-to-plant. This challenging, ready mixed concrete-specific course is the only one that helps them walk-their-walk.

The three-day curriculum and the two certification exams on Day 4 are designed to not only reinforce these specific skill levels, but also incorporates many job requirement skills found in specifications for Army Corps of Engineers’ projects, as well as state and local DOTs.

For additional information and to register for the class, please click here: https://www.nrmca.org/course/p...
