Emergency Tax Relief on Diesel Fuel

On October 5, President Trump issued an Executive Order providing temporary federal relief related to the use of dyed diesel fuel through December 31, 2026. The Administration's stated goal is to help lower fuel costs for truckers, farmers, and other diesel users while addressing ongoing fuel price and supply concerns.

For Pennsylvania, the situation is somewhat unique. Existing state law includes language that may already permit the use of dyed diesel on public highways when authorized by federal law or regulation. As a result, Pennsylvania may not require legislative action to recognize the federal relief, but significant questions remain regarding implementation, enforcement, tax collection, and regulatory guidance.

As there has been no formal action from the federal government outside of the initial executive order, we are in a "wait and see" position. We will continue monitoring developments at both the federal and state levels and will keep members informed as additional guidance becomes available.
